Federal law requires one-party consent, meaning you can record a conversation if you are part of it or if one party consents. At the state level, laws fall into two main categories:
- One-party consent states: 38 states and the District of Columbia allow recording with the consent of just one party to the conversation. This means you can record a call you're participating in without informing the other parties.
- Two-party (or all-party) consent states: 13 states require the consent of all parties involved in the conversation before recording. These states are California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, and Washington.
For compliance, especially with interstate calls, make sure to obtain consent from all parties and announce at the beginning of the call that it will be recorded.
